Relationship to Other Agreements

These Terms work together with our Privacy Policy (available at brickbear.app/privacy), which explains how we collect, use, and protect your personal information. By agreeing to these Terms, you also agree to our Privacy Policy.

Core Features

• Image upload and 3D brick model generation
• Configurable resolution and model size
• Downloadable 3D model files and building instructions
• Account dashboard for managing generations and purchases
• Gallery of community creations

Service Limitations

• Internet Connection: Required for all Services
• Service Availability: We aim for high uptime but do not guarantee uninterrupted access
• Usage Limits: Different plans have different generation limits (see Pricing)
• Supported Formats: JPG, PNG, and WebP image uploads

Third-Party Dependencies

Our Services rely on third-party services including Google OAuth for authentication, Stripe for payment processing, and cloud infrastructure providers for hosting. We are not responsible for any issues arising from these third-party services.

Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Services.

Account Creation

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Not impersonate any person or entity
• Not create an account for anyone other than yourself without permission

Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use or security breach. We are not liable for any loss or damage arising from your failure to protect your account.

One Account Per Person

Each person or business entity is limited to one account. You may not create multiple accounts to circumvent usage limits or abuse our Services.

Prohibited Activities

• Violate any applicable law or regulation
• Infringe any intellectual property rights or other rights of third parties
• Engage in fraudulent, false, misleading, or deceptive activity
• Transmit viruses, malware, or other harmful code
• Interfere with or disrupt the integrity or performance of our Services
• Attempt to gain unauthorized access to our systems or databases
• Reverse engineer, decompile, or attempt to derive the source code of our Services
• Use the Services to develop a competing product

User Responsibility for Generated Models

You are solely responsible for how you use the brick models and instructions generated by our Services. You must ensure your use of generated content complies with all applicable laws, including intellectual property laws.

Consequences

Violations may result in immediate account termination without warning or refund. You are liable for all damages and legal consequences arising from prohibited activities.

Our Services

BrickBear and its Services (including the website, algorithms, documentation, and all related technology) are owned by BrickBear and are protected by copyright, trademark, trade secret, and other intellectual property laws worldwide.

Generated Models

You retain rights to the brick models generated from your uploaded images. However, you are solely responsible for ensuring your use of generated models does not infringe third-party rights. We make no warranties about the generated models' functionality, legality, or non-infringement.

License from You to BrickBear

By using the Services, you grant BrickBear a worldwide, non-exclusive, royalty-free license to store and process your uploads to provide the Services, and to use anonymized, aggregated usage data to improve our Services.

Feedback

If you provide feedback or suggestions regarding the Services, you agree that BrickBear may use such feedback for any purpose without compensation or attribution.

Payment

By purchasing generations, you agree to pay all applicable fees and provide valid payment information. We use Stripe for secure payment processing. We do not store your complete credit card information.

Refund Policy

All sales are final. Fees are non-refundable except at our sole discretion or as required by law. We do not provide refunds for unused generations or account terminations for Terms violations.

Price Changes

We reserve the right to change pricing at any time. We will notify you of material price changes at least 30 days before they take effect.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT THE RESULTS OBTAINED WILL BE ACCURATE OR RELIABLE. YOU USE THE SERVICES AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRICKBEAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED DOLLARS ($100 USD).

By Us

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms.

By You

You may terminate your account at any time by deleting your account through account settings or contacting support.

Effect of Termination

Upon termination, your right to access the Services immediately ceases. We may delete your account data within 30 days. No refunds will be provided for any fees already paid.
